Dear Client,

The amendment to consumer rights legislation passed in June 2014 made it compulsory for brokerage companies to inform their clients of their legal right of withdrawal. The legislator has used this amendment as an opportunity to strengthen consumer rights. In order to comply with the change, we are informing our clients as clearly as possible of the cancellation process. Companies are responsible for providing evidence that their clients have been informed of their right of withdrawal.

We are striving to make the cancellation process as straightforward and as transparent for our clients as possible. 

As you can see, we are not overwhelming our clients with additional terms and conditions, but instead are actively informing you of your rights.

We hereby expressly inform you that, as was previously the case, you are only required to pay commission if a rental or purchase agreement is concluded. If you decide not to rent or purchase the property proposed by us, you will, of course, not be obliged to pay any commission. Whether you request information online or visit us for a personal consultation, we hope that our services bring you a step closer to finding your dream property.  

You may withdraw from this contract within 14 days without stating the reasons for doing so. The withdrawal period is fourteen days from the date on which the contract is concluded. To exercise your right of withdrawal, you must inform us (WARNHOLZ Immobilien GmbH, Treptower Str. 143, 22147 Hamburg, Germany, fax: +49 (0)40 6470168, email: post@warnholz-immobilien.de) of your decision to withdraw from this contract by making a clear statement to this effect (e.g. in the form of a letter sent by post, a fax or an email). To do so, you may use the sample withdrawal form available on our website or in an attachment to the email confirming your request. However, the use of this form is not obligatory. Provided that the correspondence stating your wish to exercise the right of withdrawal is sent before the expiry of the withdrawal period, the withdrawal period shall be deemed to have been observed.

CONSEQUENCES OF THE WITHDRAWAL

If you withdraw from this contract, we are obliged to repay all the payments which we have received from you without delay and within fourteen days from the date on which we received notification of your withdrawal from this contract. To make this repayment, we will use the same method of payment that you used for your original transaction, unless another method was expressly agreed with you; you will not be charged fees for this repayment under any circumstances.

If you request that our services begin during the withdrawal period, you are obliged to pay us an appropriate amount corresponding to the proportion of the services set out in the brokerage contract that have already been performed by the date on which you inform us of your withdrawal from this contract.
